The Supreme Court announced Tuesday that it will hear arguments on the constitutionality of Obama’s plan to grant quasi-amnesty to up to 5 million illegals.
The Court affirmed that it will take up the case this April, and decide it by June, in a decision that could create big waves in the presidential race, the Associated Press reported.
The ruling will mainly effect illegal immigrants who unlawfully migrated but bore children on U.S. soil, thus making them rightful citizens; legitimizing Obama’s plan would grant the parents of these children numerous amenities.
The lower courts have continuously sided with the 26 states, led by Texas, that have challenged the president’s plan to grant work permits and federal benefits to nearly 5 million illegal aliens, according to the Associated Press.
Texas asked the court not to hear the case, but Texas Attorney General Ken Paxton said he was pleased the justices will examine and judge the president’s constitutional authority to intercede without congressional approval. “In deciding to hear this case, the Supreme Court recognizes the importance of the separation of powers,” Paxton said.
Democrat officials and pro-immigrant advocates praised the court’s action. Democratic Senate Leader Harry Reid of Nevada said that “law-abiding men and women continue to live in constant fear of being separated from their children. These families must be allowed to step out of the shadows and fully contribute to the country that they love and call home.”
