Family celebrates property-rights victory over meddling homeowners association

PlaysetA Missouri family is celebrating after a judge’s ruling allowing them to keep a purple play set in their yard despite heavy handed tactics from their homeowners association.

The Stout family of Lee’s Summit told KMBC that the homeowner’s association fined them and even threatened jail time if they did not paint the play set a more neutral color.

The problems for the family started last year when they made a compromise with their children, who wanted the play set painted pink, to settle on purple.

That’s when they fought, and won, against a fine they received from the association. But the brouhaha didn’t stop there.

The homeowner’s association started sending letters threatening sanctions, and more.

“(The letters said) that if we didn’t remove the swing set from the subdivision in a couple of weeks, we go to jail,” Maria Stout told KMBC.

The family told KMBC they got the neighbors who were most affected by it, because they could see the play set from their homes, to sign a petition asking that they be allowed to keep it, but the homeowner’s association would not relent.

“I think it’s ridiculous,” next door neighbor Dillen Steeby said. “I’m really perturbed that they would waste money pursuing something like this. Money on court costs and lawyer’s fees to attack really good people like this and go after a swing set.”

Friday’s verdict in favor of the Stouts will hopefully end the saga once and for all.
