Democrats and their corporate media allies have proven time and again there are no sacred cows on the path to eroding the integrity of U.S. institutions as they endeavor to “build back better.” Their latest low besmirched the reputation of the Secret Service solely to further the Jan. 6 narrative.
The bombshell that wasn’t from former White House aide Cassidy Hutchinson sent the Jan. 6 committee down another rabbit hole of exploitive propaganda to push the idea that members of the Secret Service were somehow complicit in the events of the day only after claiming that then-President Donald Trump had gone rogue in an attempt to overpower his security detail.
Hutchinson’s hearsay prompted Secret Service members like assistant director Tony Ornato and the head of Trump’s Secret Service detail, Robert Engel, to volunteer testimony to set the record straight, and their desire to have legal counsel was treated as enough by MSNBC legal analyst Glenn Kirschner to assign them guilt.
After Rep. Zoe Lofgren (D-CA) told the press Thursday, “Some of the officers said that they would be coming and talking under oath. They have not come in, and they recently retained private counsel, which is unusual but they have a right to do that,” Kirschner joined MSNBC’s “The Katie Phang Show” to decry the move.
“Yeah, Katie, listen, I embrace anybody’s Sixth Amendment right to counsel, just like I embrace anybody’s Fifth Amendment right against self-incrimination. These are important constitutional rights that we have, at least until the Supreme Court chooses to take them away,” he said adding a partisan dig at the overturn of Roe v. Wade.
“But there is an incongruity here when a law enforcement agency like the Secret Service, lawyers up, or members of the Secret Service lawyer up because they are afraid of the consequences to come,” Kirschner alleged, “or just the questions that will be put to them about why they erased their text messages.”
The former federal prosecutor had been primed by Phang who noted the recent investigation into Secret Service phone logs from Jan. 6 that had come up empty. The Department of Homeland Security (DHS) had instructed the Secret Service to cease any investigation that they were conducting into the lack of messages described as “erased as part of a device-replacement program.”

“But what messages is that sending to you about the absence of evidence?” Phang had asked. “There’s none. There’s no phone call logs. There’s no photographs of the president now. There’s no text messages.”
“I worked criminal cases with the Secret Service,” Kirschner detailed, “including a case where a senator had his cell phone stolen and we had to use technology to track the thief through the city until we found him, caught him and put him on trial and convicted him. And here is the thing that really gets me so frustrated. The Secret Service is the premier law enforcement organization when it comes to investigating cyber crime. When I had cell phones or computers seized as part of my criminal investigations and I needed forensic searches done on them, particularly if evidence had been deleted and needed to be retrieved, I didn’t go down to the FBI lab at Quantico.”
“I went to the United States Secret Service Forensic Sciences Division, and they’re the ones who retrieved deleted information off of cell phones and computers,” he explained. “So now what? They can’t retrieve their own deleted information? I’m not buying it. I believe there’s adequate predication, that is, enough evidence to open a criminal probe. And if the Secret Service did nothing wrong, they should welcome that criminal probe.”
What Kirschner left out was the fact that the Secret Service was actively working to determine if the ten individuals that may have sent messages that qualify as government records had done so and failed to preserve them before DHS stepped in. No, instead he has chosen the course of guilty until proven innocent as the Secret Service is maligned and potentially forced to disprove an unfalsifiable argument.
