A Los Angeles judge ruled that a California law mandating who companies can include on their boards in order to espouse diversity is unconstitutional, a stinging rebuke to “woke” leftist activists who sought to force corporate entities to do their bidding.
On Friday, Los Angeles County Superior Court Judge Terry Green ruled in favor of conservative watchdog Judicial Watch which had filed a lawsuit arguing that the landmark law which was signed by Governor Gavin Newsom in 2020 violated the state’s equal protection clause.
The law required that publicly traded companies that had a main executive office in the state have at least one member from an “underrepresented community” on their boards by the end of 2021, the groups included are blacks, Asian, Latino, LGBT, Native American and Pacific Islander, either through filling a vacant board seat or adding a new one.
“When we talk about racial justice, we talk about empowerment, we talk about power, and we need to talk about seats at the table,” Newsom said of the law which was included with other “racial justice measures” that were a reaction to the summer of racial unrest following the unfortunate death of career criminal and drug addict George Floyd who perished as a result of an encounter with police while resisting arrest.
“The measure requires at least two such directors by the end of 2022 on boards with four to nine directors. Three directors are required for boards with nine or more directors. Firms that don’t comply would face fines of $100,00 for first violations and $300,000 for repeated violations,” Associated Press reported at the time of the bill’s signing.
While Judge Green did not provide a reasoning behind the ruling, it was a significant setback for the cultural revolutionaries on the left, especially since it was found to be too radical for even California.

Judicial Watch hailed the ruling in a press release. “This historic California court decision declared unconstitutional one of the most blatant and significant attacks in the modern era on constitutional prohibitions against discrimination,” said Judicial Watch President Tom Fitton.
“In its ruling today, the court upheld the core American value of equal protection under the law. Judicial Watch’s taxpayer clients are heroes for standing up for civil rights against the Left’s pernicious efforts to undo anti-discrimination protections,” the statement read.

Market economics should not be ruled with governmental red tape. In order for companies to be profitable, they must hire the best people. Having their hands tied by governmental regulations will lead companies to chapter 11.
