The infamous madam of Jeffrey Epstein is asking for a retrial after it was revealed that a juror was not entirely forthcoming with their own history of childhood sexual trauma at the time of jury selection.
Ghislaine Maxwell’s lawyers argue that her conviction is in question after a juror reportedly discussed the matter with several media sources, and revealed his own battle with sex abuse, according to Reuters.
He also maintains that he was never asked about his abuse history during the selection process, but reports indicate that prospective jurors were, in fact, asked multiple questions on the topic. He also says he was entirely honest throughout the answering process, and “flew through” the questionnaire.
According to NBC News:
The juror, who was identified only by his first and middle names, Scotty David, 35, in recent interviews with Reuters and British newspaper The Independent, had previously said he “flew through” an initial questionnaire ahead of the trial.
This is enough for a new trial according to Maxwell’s defense team.
In December 2021, Maxwell was convicted of five of the six counts she was facing. The former socialite is looking at up to 65 years behind bars, which at her age could mean spending the rest of her life in prison.
Her defense team has also claimed that the jury pool was not diverse enough, at one point argued that her agreement in the previous Epstein prosecution protected her, and requested that the indictment be thrown out due to vagueness.
“The fact that Ms Maxwell herself is neither Black nor Hispanic does not deprive of her of standing to raise this challenge,” the attorneys said, arguing that the American Constitution “entitles every defendant to object to a [pool] that is not designed to represent a fair cross-section of the community, whether or not the systematically excluded groups are groups to which he himself belongs.”
