The states of Utah and Minnesota are both facing potential discrimination lawsuits because they have issued guidelines determining eligibility for COVID monoclonal antibodies treatment based on race and ethnicity.
The Utah and Minnesota Departments of Health both published guidance notifications pushing prioritization of treatment based on race according to the Daily Mail. Utah included a COVID risk scorecard for medical professionals to assess a patient’s level of risk determined by a number of medical factors, with “non-white race or Hispanic/Latinx ethnicity” scoring two extra points.
Fox News host Tucker Carlson tore into it on his show Monday, “In Utah, COVID patients are triaged by a scoring system that determines whether they qualify for these potentially life-saving antibody treatments. If you look at the scoring system, you’ll notice that race often counts more than physical health. The state of Utah, for example, gives two points to anyone simply for not being white. You win if you’re not white. If you have congestive heart failure at the same time, you get one point. So if you’re a white, congestive heart failure patient, that’s not enough for you.”
“It’s the same story in Minnesota. Minnesota awards two points to so-called BIPOC patients. That means anyone who’s not white. If you have high blood pressure and you’re 60 years old, you get one point. So tough luck for you. Imagine if that was one of your parents. It is one of someone’s parents,” he charged.
“This is not healthcare, it’s punishment, it’s punishment meted out on the basis of skin color. Now the justification for all of us, and the authorities could not be clearer about it, they’ve taken their ideas directly from America’s colleges, they’ll tell you why they’re doing this, the justification is history. The United States has mistreated racial minorities in centuries past, they say. Therefore, whites must suffer now. So your ancestors did bad things or people who looked like your ancestors did bad things. So now we’re withholding medicine from you. They call this equity. It’s not equity. It is collective punishment. It’s the North Korean standard. It’s the definition of evil,” Carlson proclaimed.

America First Legal, which is a conservative law group founded by former President Trump adviser Stephen Miller, claimed the policies violated federal law through “blatant discrimination.”
“Using a patient’s skin color or ethnicity – rather than the unique and specific medical circumstances of an individual patient – as a basis for deciding who should obtain lifesaving medical treatment is appalling,” the group wrote in letters obtained by Fox News.
“The color of one’s skin is not a medical condition akin to hypertension, heart disease, or obesity, which are known to aggravate the risk of death or severe illness among those infected with COVID-19,” the group continued.
“Directing medical professionals to provide or deny medical care based on immutable characteristics like skin color, without regard to the particular health conditions of the individual patients who are seeking these life-saving antiviral treatments, is nothing more than an attempt to establish a racial hierarchy in the provision of life-saving medicine,” they concluded.
The FDA is suggesting race should be a deciding factor in whether or not someone is “high risk” and therefore qualified to receive certain COVID treatments.

In a press release sent out on Tuesday, the Utah Department of Health defended its policy, stating that “non-white race or Hispanic/Latinx people are 35-50% more likely to be hospitalized” than white people are.
“For those who do not automatically qualify, the risk score was developed to include other factors proven to increase risk of hospitalization and death from COVID-19,” the agency attempted to explain. “Each factor in the risk score represents a condition or characteristic that has been shown to put a person at elevated risk for severe disease or hospitalization.”
Allegedly an individual does not automatically qualify for treatment solely based on race or ethnicity in Utah or Minnesota but it is a large factor in determining treatment.
Minnesota asserts it is following FDA recommendations which claim there is a racial disparity in COVID cases. The agency argues that race and ethnicity “may also place individual patients at high risk for progression to severe COVID-19.”

Miller contends that the policies are discriminatory against white people.
“These racist policies decide questions of life and death based on skin color and must be rescinded immediately. It’s an abomination,” he claimed.
“They radically violate federal law, the United States Constitution, and the sacred principle of equal justice for all. No right is safe if the government can award or deny medical care based on race. End this horrid injustice,” he demanded.
Gene Hamilton, who is AFL’s vice-president and general counsel, said the policies are “rooted in Marxist principles and social justice.”
They “demand the use of government power to distribute and redistribute resources not based on equal rights, but based on ‘equity,’” he noted in a statement according to The Epoch Times.
“All Americans who reject the influence of Marxism and support equal rights for all should prepare themselves to fight back against these efforts in the weeks, months, and years ahead. We at America First Legal will not stand by idly and let this happen,” Hamilton stated.

Texas and many other state are doing this as well, These guidelines were suggested by the Biden administrator on the grounds of so called equity. They did the same thing with farmers and restaurants colored people only. #Civlirights act is ignored in this country.
