On Sunday, Judge Amy Berman Jackson denied Roger Stone’s request that she be disqualified from future proceedings in the case, to include whether the former Trump adviser will be granted a new trial. Stone’s attorneys had filed a motion on Friday that she be removed, arguing that she had displayed her bias in the case.
The crux of defense attorneys’ formal objection to Jackson is that she commented during Stone’s sentencing hearing on February 20 that “the jurors who served with integrity under difficult circumstances cared.”
“Given the statements made by Judge Berman Jackson during the Sentencing Hearing, recusal … is warranted in order to protect the integrity and impartiality of the judicial system,” Stone’s attorneys wrote.
On February 14, Stone’s attorneys had filed a request for a retrial after discovering the head juror, Tomeka Hart, misled the court during the jury selection process about her ability to be impartial, given her past social media posts, some of which have since disappeared from her Twitter feed, that clearly reflected not only her interest in the developing Stone case but also her strong anti-Trump views and that she believed all Trump supporters are racists.
U.S. District Judge Jackson, an Obama-appointee, took little time to deny the request for her disqualification. She issued her filing on Sunday, in which she wrote: “There is no rule and no case-law that would justify the recusal of a judge for bias simply because he or she says something about an issue on the docket, on the record, at some point before a reply has been filed, or before a hearing – which may or may not be required in the court’s discretion – has concluded.”
The Stone case, by almost all accounts a political hit job, emerged out of the Mueller investigation. From the very beginning it was all about the news coverage and trying to impact public opinion. In January 2019, CNN was exclusively tipped off to a dramatic predawn raid of Stone’s home by 29 armed FBI agents decked out in tactical gear and body armor as if they were taking down an ISIS command center. The 66-year-old Stone came out of his Fort Lauderdale home barefoot with his hands above his head. The whole episode has become a dictionary illustration for the word “overkill.”
The longtime D.C. political adviser, whose influence and involvement in Washington power circles go as far back as the Nixon administration, was charged with seven counts–five for giving false statements, one for witness tampering, and one for obstruction of justice.
The politically divisive nature of the case was reemphasized when earlier this month, politically biased prosecutors on the case revisited the overkill theme by recommending sentencing of Stone for up to nine years in prison, a harsh move that President Trump called a “miscarriage of justice” and a “horrible and very unfair situation.”
Four prosecutors immediately resigned the case under protest of Trump’s comments.
Ultimately, Judge Jackson last week sentenced Stone to 40 months behind bars.
Stone has continually denied any wrongdoing and consistently criticized the case against him as politically motivated.
