Harvey Weinstein is actually being sued now over sexual assault allegation

Fortune has changed rapidly for Harvey Weinstein, who has gone from being one of the most powerful men in Hollywood to being a pariah buried underneath countless sexual abuse allegations.

Weinstein’s reputation has been irreversibly destroyed in the court of public opinion. Now he has to defend himself in the actual court of law.

An anonymous actress who claims to have been raped by the entertainment mogul in 2016 is suing both Weinstein and the Weinstein Company, according to the Hollywood Reporter.

The accuser, who is currently known only as Jane Doe, says the Weinstein Company knew of the producer’s “repeated acts of sexual misconduct” prior to the time of her alleged rape.

Representing the anonymous actress is controversial women’s rights attorney Gloria Allred. The complaint was filed by Allred on Tuesday in Los Angeles County Superior Court.

Doe asserts she met Weinstein during a 2011 party at California’s luxurious Chateau Marmont hotel. Upon learning she was an actress, Weinstein allegedly offered to help her land roles and asked for her phone number.

The two remained in touch over the next few years, with the actress accompanying Weinstein to industry parties and events.

Things allegedly took a turn for the worse in late 2015, when Weinstein met Doe at Montage Hotel in Beverly Hills to talk about several potential acting jobs.

Allred writes:

“Despite her telling Weinstein ‘no,’ Weinstein proceeded to grab her wrist with one hand while using the other to masturbate in front of her until completion.”

Despite the experience, Doe met him at the Montage again the following spring, believing she had been chosen for a part. On this occasion, the actress says she was raped.

The complaint argues that the Weinstein Company knew “of Weinstein’s pattern of using his power and the promise of procuring jobs to coerce and force actresses to engage in sexual acts with him.”

Doe bases her claim on the existence of a clause in Weinstein’s contract with the company which specified that the producer would have to reimburse the Weinstein Company for any settlements paid in response to misconduct suits.

The actress is suing for sexual battery, gender violence, battery, assault and negligence. A representative for Weinstein issued the following response:

“Any allegations of non-consensual sex are unequivocally denied by Mr. Weinstein. Mr. Weinstein has further confirmed that there were never any acts of retaliation against any women for refusing his advances. Mr. Weinstein obviously can’t speak to anonymous allegations, but with respect to any women who have made allegations on the record, Mr. Weinstein believes that all of these relationships were consensual.”

The court’s have not yet found Weinstein guilty of the myriad of alleged crimes.
