Undeterred Trump says he may file a brand new order in the face of 9th court decision; he has options

President Donald Trump is not deterred by the court defeat on his immigration executive order and may be crafting a “brand new order” in response.

“We’ll win that battle, but we also have a lot of other options, including just filing a brand-new order,” Trump told members of the press aboard Air Force One on Friday.

He could have something as soon as “Monday or Tuesday,” the president said, stressing that “we need speed for reasons of security.”

This strategy could mean the administration would be presenting and implementing a new executive order while simultaneously continuing the legal fight over the first one.

On Thursday, the 9th U.S. Circuit Court of Appeals upheld a temporary restraining order suspending Trump’s travel ban from seven Muslim-majority nations. The panel of three judges with the extremely liberal San Francisco-based Court delivered a unanimous decision.

While the president revealed that there would be “very little” changes to a new order,  security measures would remain a focus.

“We’re going to have very, very strong vetting. I call it ‘extreme vetting.’ And we’re going to have very strong security in our country,” Trump said. “We are going to have people who come into our country that want to be here for good reasons.”

Trump’s senior adviser, Kellyanne Conway, believes that with the 9th Circuit decision, the Court “seemed to supplant the president’s judgment about national security with its own.”

“That’s not an appropriate use of its authority,” she told Fox host Eric Bolling on “The O’Reilly Factor” on Friday.

Conway was “fully confident” that the initial order would “prevail on the merits” of the case and the president has several options moving forward.

“We can obviously go back to the District Court. Some people said take it all the way to the Supreme Court,” Conway said. “He certainly always has the opportunity to put out new executive orders but the president will make that decision in due course.”
