The FBI and Department of Justice may have created an unintended precedent when it gave Hillary Clinton a pass for mishandling classified information — a sailor is citing Clinton’s case in his bid for leniency for taking classified photos inside a nuclear submarine.
Petty Officer 1st Class Kristian Saucier pleaded guilty to taking and retaining six photographs of the U.S.S. Alexandria’s propulsion system, which he knew to be classified, in 2009. He is scheduled to be sentenced Friday in federal court on a single felony count, according to Politico.
Although defense attorney Derrick Hogan agrees with prosecution that the sentence guidelines for the crime of retaining national defense information without permission calls for a prison term of 63 to 78 months, he said his 29-year-old client should get probation instead, citing Clinton’s treatment as precedent.
“Democratic Presidential Candidate and former Secretary of State Hilary [sic] Clinton … has come under scrutiny for engaging in acts similar to Mr. Saucier,” Hogan wrote in his sentencing memorandum.
He added that “FBI Director James Comey said that there was ‘110 emails and 52 email chains’ that were deemed classified” on Clinton’s server — 36 chains contained “secret information and eight contained “top secret” information.
“In our case, Mr. Saucier possessed six (6) photographs classified as ‘confidential restricted,’ far less than Clinton’s 110 emails,” Hogan wrote. “It will be unjust and unfair for Mr. Saucier to receive any sentence other than probation for a crime those more powerful than him will likely avoid.”

Plenty of people took to social media to give Saucier a huge thumbs up — “and justice for all,” right? The phrase, “Equal justice under law” is engraved on the front of the United States Supreme Court building.
