Conservative talk radio host Hugh Hewitt was only too happy to instruct others on constitutional law as well as offer some historic perspective on Supreme Court appointments during a president’s last year in office.
Hewitt indicated that lame duck presidents don’t have the luxury of making lifetime appointments.
No. It won’t. No hearings. No votes. Lame ducks don’t get to make life-time appointments. https://t.co/iaCvV31JwQ

This was followed in short order by a misstatement of the Constitution advanced by University of Chicago economics Professor Austan Goolsbee who tweeted:
Oh, how quickly the “strict constitutionalists” disregard what the constitution actually says https://t.co/FVqHXagEyc
— Austan Goolsbee (@Austan_Goolsbee) February 14, 2016
The radio host explained further:
Article II, Section 2, Clause 2. Read it. No timeframe. No obligation to hold hearings or votes. See Ds 2001-2005 https://t.co/Ap5nH92LHA

Preisdent can nominate. Senate chooses whether to confirm. That’s it. That’s the Constitution. Read it. https://t.co/XGTMguDBfR

Author and MSNBC host Joy Reid brought up President Ronald Reagan’s nomination of Justice Anthony Kennedy — who was confirmed by a Democratic Senate in Reagan’s last year in office in 1988.
Follow up question: “Was Ronald Reagan unjustified in nominating Justice Anthony Kennedy in his final year during an election year in 1988?”

Time for the history lesson.
Joy: He was nominated in 1987, after Ds slandered/rejected Judge Bork. Original vacancy was June 1987. https://t.co/lPHZTlgwZ6
— Hugh Hewitt (@hughhewitt) February 14, 2016
That vacancy occurred in June 1987, followed by Bork blockade then Kennedy nomination in 11/87. https://t.co/dNjKuChyYS

The outrage on left suggests they know @GOP will hold together on this and that it is a winning argument with public. Won’t be steam rolled
— Hugh Hewitt (@hughhewitt) February 14, 2016
Incidentally, Sen. Pat Leahy, D-Vt., had a lapse of memory during his Sunday appearance on CNN’s “State of the Union.”
He also (wrongfully) claimed Kennedy was appointed in 1988.
