Residents of a small Oregon community that came all too close to a bad guy with a gun voted to reaffirm their Constitutional gun rights.
Coos County voters passed a measure, Tuesday, that directs the sheriff to ignore federal and state gun control laws that he deems unconstitutional, according to the Huffington Post.
The bill, known as the 2nd Amendment Preservation Ordinance, which passed with a whopping 61 percent of the vote, instructs the sheriff to determine which laws violate the Constitution and forbids county funds from being used to enforce those laws, with violators being fined $2,000.
It is unclear, however, if the law is legally enforceable.
“I’m not sure the courts would agree with that concept,” Coos County Sheriff Craig Zanni told The Oregonian last month. “I would just bet there would be some legal challenges to it.”
Portland-based constitutional law expert, Charlie Hinkle, told the Huffington Post that the law is unenforceable.
“Of course local officials can’t decide what laws are constitutional. That’s why Kim Davis went to jail,” he said, referring to the Kentucky County clerk who denied same sex marriage licenses. “Even the president can’t decide what’s constitutional — that’s why a federal court enjoined his executive orders regarding immigration.”
It’s fair to say that people in that part of the state are not big fans of liberal policies, as many protested the visit of President Obama to Umpqua Community College after the mass shooting that occurred there last month.
