Illegal immigrants are going to be able to vote in California now that a new bill has become law.
That’s what judge Andrew Napolitano said Tuesday on “Fox & Friends,” about a new law signed by Gov. Jerry Brown that automatically registers a person to vote when they get or renew their driver’s licenses.
The issue is that California does not require proof of American citizenship to acquire a driver’s license.
As Napolitano explained, other states allow drivers to register to vote when they obtain their license. But in these other states, registering to vote requires another step to prove citizenship.
“You may not even know that when you get your driver’s license you’re also being registered to vote. And there’s no requirement of proof of citizenship.” Napolitano said, “All 50 states limit voting to citizens except when the state allows you to sort of sneak in without proving your citizenship by getting a driver’s license instead.”
The issue, Napolitano said, is that the Supreme Court has determined voting is a fundamental right like that of free speech.
“The Supreme Court has wrongly said it’s a fundamental right. And once it said that, states like California decided to allow people to vote who aren’t qualified by law to vote because of the fundamental aspect.”
