Baltimore Judge shoots down Marilyn Mosby’s request for gag order in Freddie Gray death

State’s Attorney Marilyn Mosby has lost her bid to put a gag order on the defense lawyers for the police officers charged in the death of Freddie Gray.

According to Reuters, Mosby had asked a Circuit Court to hold a hearing for a “protective order,” effectively prohibiting the officers or their lawyers from publicly speaking about the case.

The death of Gray, a 25-year-old black man who died from a spinal injury suffered while in police custody, prompted Mosby to charge six Baltimore police officers in the death, with offenses ranging from misconduct to second degree murder. A trial is set for October.

As protests over Gray’s death grew, Mosby faced criticism that the charges were politically motivated – a charge that was raised again when she decided to push for a gag order in the case.

Judge Barry Williams on Monday said there was no apparent reason for a protective order, and refused Mosby’s request to hold a hearing on the matter.

“There simply is no basis in the assertions presented to the court for the broad and extraordinary relief sought in the motion,” he said in his ruling, adding that defense lawyers had already been proven capable of responsibly handling sensitive information about the case.

When asked for a comment on the ruling, a spokesperson for Mosby said “We will litigate this case in the courtroom, not the media.”

Those are strong words from a prosecutor who wanted to silence the very cops she charged with murder while “black lives matter” protests raged on in the city.
