A former Baltimore city prosecutor says he was “deeply disturbed” by way Baltimore State’s Attorney Marilyn Mosby charged six police officers in the death of Freddie Gray.
Kurt Nachtman, who previously worked with Mosby, appeared “On The Record” and told Fox News host Greta Van Susteren that the prosecution doesn’t appear to have a coherent theory in charging the Baltimore officers.
“I think that this case, frankly, is either overcharged or undercharged. Part of the problem is it seems like the prosecution has a shifting theory of the case,” he told Van Susteren.
“First they started off with this knife, then they’re saying that the arrest that was made lacked probable cause, and now, based … on the response to the bill of particulars that was filed, it seems as though they’re saying the van was somehow the instrumentality of the actions of the officer,” he explained.
Van Susteren asked Nachtman if Mosby was in “over her head,” as many other court observers have said.
“I think that maybe she is over her head, but you know, it’s one of those situations where you would hope that the person who’s charged with being the lead prosecutor for a major metropolitan area is going to take their time and is going to be deliberate and thoughtful when they’re making such a huge decision,” Nachtman said.
He referred to Mosby’s rush to judgment as “a political statement,” adding that “it appears as though it was done too quickly.”
