The Obama administration has found out again that it’s not above the law — and now it’s whining about it.
The White House on Tuesday slammed a Fifth Circuit Court of Appeals ruling that upheld U.S. District Judge Andrew Hanen’s February decision that halted the president’s executive amnesty for illegal aliens.
Obama administration lawyers argued that Hanen’s temporary hold was a threat to national security, but the appeals court didn’t buy it.
“Today, two judges [Jerry Smith and Jennifer Walker Elrod] of the Fifth Circuit chose to misinterpret the facts and the law in denying the government’s request for a stay,” White House spokewoman Brandi Hoffine said in a statement.

“The president’s actions were designed to bring greater accountability to our broken immigration system, grow the economy, and keep our communities safe. They are squarely within the bounds of his authority and they are the right thing to do for the country,” she said.
One judge, Stephen Higginson, dissented from the majority, saying “deferred action has existed for half a century, reflected in longstanding regulations.”
Ken Paxton, the attorney general for Texas, which was one of 26 states to bring the original lawsuit against the administration, praised the decision. In a statement, he said Obama tried to force “a drastic change in immigration policy” and said the decision is “a victory for those committed to preserving the rule of law in America.”
“We will continue to fight the brazen lawlessness that has become a trademark of the Obama administration,” he added.
