Baltimore prosecutor asked to recuse herself over multiple conflicts of interest

Just prior to six Baltimore police officers being charged in the death of Freddie Gray, the Fraternal Order of Police released a letter calling on State’s Attorney Marilyn Mosby to recuse herself.

Citing her personal connections to the Gray family’s attorney and her marriage to a city councilman, Gene Ryan, president of Fraternal Order of Police Lodge 3, requested Mosby appoint a special prosecutor, The Baltimore Sun reported.

Ryan also said the officers involved are innocent.

“Not one of the officers involved in this tragic situation left home in the morning with the anticipation that someone with whom they interacted would not go home that night,” he wrote. “As tragic as this situation is, none of the officers involved are responsible for the death of Mr. Gray.”

The letter was released Friday and drew attention to some “very deep concerns about the many conflicts of interest” involving Mosby.

“These conflicts include your personal and professional relations with Gray family attorney, William Murphy, and the lead prosecutor’s connections with members of the local media,” Ryan said. “Based on several nationally televised interviews, these reporters are likely to be witnesses in any potential litigation regarding this incident.”

According to The Sun, Murphy not only donated $5,000 to Mosby’s campaign, but also served on her transition committee.

Ryan also expressed concerns about Mosby, who has been in the job four months, being married to Baltimore City Councilman Nick Mosby.

“Most importantly, it is clear that your husband’s political future will be directly impacted, for better or worse, by the outcome of your investigation,” he said. “In order to avoid any appearance of impropriety or a violation of the Professional Rules of Professional Responsibility, I ask that you appoint a Special Prosecutor to determine whether or not any charges should be filed.”

The letter will likely have little impact on Mosby’s decision to charge the officers, with a spokeswoman disputing any concerns about a conflict of interest.

“Hundreds of people donated to her campaign,” spokeswoman Rochelle Ritchie said, according to The Sun. “There is no conflict of interest surrounding Billy Murphy. He is representing the family in a civil case which has nothing to do with the criminal case.”
