Judge Nap: Hillary couldn’t have been telling the truth — and here’s why

Fox News analyst and former judge Andrew Napolitano gave a rundown Wednesday on why former Secretary of State Hillary Clinton was probably lying during the news conference she gave Tuesday to explain using a private email server for government business.

And he didn’t just mean because her lips were moving.

“Her denials were not believable. Her arrogance was palpable. Her misunderstanding of the law was obvious,” Napolitano said on the Fox Business Network’s “Varney & Co.”

Clinton’s big problem, Napolitano said, is that she argued she complied with all relevant laws about preserving government records because her email correspondence with other government employees would be archived.

But email exchanges with government employees wouldn’t cover all the email correspondence of a woman in the secretary of state’s position.

“What about when she emailed with someone in a foreign government? What about emails she didn’t reply to? This is an absurd argument,” he said. “What about the 30,000 emails that she deleted on her own? Her own words belie what she’s been saying.”

Predicting a legal battle ahead, Napolitano said U.S. Rep. Trey Gowdy, the South Carolina Republican who chairs the House Select Committee on Benghazi, will attempt to have the House of Representatives subpoena Clinton’s email server to get possession of all records on it.

Then the government that Clinton loves to push on her fellow citizens can decide what belongs to her and what belongs to the public.

“The statute presumes these emails are government documents,” Napolitano said. “Case closed.”
