The Obama administration announced it will seek an emergency order Monday paving the way for amnesty to illegal immigrants, despite a federal judge’s temporary restraining order.
Both the government and immigrant rights advocates are trying to find a way to grant legal status to millions of undocumented immigrants who have come to America illegally, according to The Hill.
“We — as immigrants and as Americans — have waited for nearly a quarter century for these much-needed improvements to our broken immigration system,” Marielena Hincapié, head of the National Immigration Law Center, said in a statement Friday, The Hill reported. “We should not allow a flawed legal decision to delay these changes any longer.”
The Justice Department is also appealing the federal restraining order that stopped the amnesty process, the White House announced.
“We will seek that appeal because we believe when you evaluate the legal merits of the arguments, that there is a solid legal foundation for the president to take the steps he announced last year to help reform our immigration system,” White House press secretary Josh Earnest said.
Republicans were displeased with the request for an emergency stay, but they weren’t taken aback by the news.
“[It’s] no surprise that the most partisan and imposing Department of Justice of our time would rush to defend the president’s lawless actions,” U.S. Rep. Lamar Smith, R-Texas, said, according to The Hill. “Putting a stop to these overreaching executive actions isn’t about Republicans or Democrats; it’s about respecting and restoring the rule of law.”
The federal order prohibiting the administration from implementing the president’s executive actions was granted in a case filed by 26 states, led by Texas.
“The President’s stay request should be denied,” Texas Gov. Greg Abbott said in a statement on his website. “A stay is typically granted to have the status quo maintained. Here the status quo is the immigration law passed by Congress, not the executive action by the President that rewrites immigration law. The President’s lawless trampling of the Constitution thwarts the status quo.”
