Man sues surgery center after waking up wearing pink panties

A Delaware man found something he didn’t bargain for when he woke up after a colonoscopy at his surgical center.

Pink is evidently not a pleasing color to the man the News Journal identified as Andrew Walls, 32.

He’s filed a lawsuit against the Delaware Surgery Center in Dover, charging it with intentionally inflicting emotional distress.

“The defendant’s extreme and outrageous conduct went beyond all possible bounds of decency,” Walls’ lawsuit states.

To make matters worse, Walls was an employee of the surgery center at the time of the Oct. 12, 2012 incident and argues that embarrassment caused it forced him to lose his job. In addition to the emotional distress, the suit seeks compensation for lost wages and loss of earning capacity, according to the News Journal.

A spokeswoman for the surgery center declined to comment to the paper.

It’s not clear why anyone at the surgery center would have placed the patient in pink panties, though it might have been a prank. The lawsuit makes it clear, though, that it’s not the kind of underwear Walls had on when he went under.

“When the plaintiff recovered from the effects of the anesthesia administered by defendants, he awoke to realize that while he was unconscious pink women’s underwear had been placed on his body,” the lawsuit states.

“When the plaintiff initially presented for his colonoscopy he had not been wearing pink women’s underwear and at no time did the plaintiff voluntarily, knowingly or intentionally place the pink women’s underwear upon himself.”

And don’t let anyone tell you different.
