Sounding anything but penitent hours after pleading guilty to campaign finance violations in federal court, conservative film maker Dinesh D’Souza appeared on Megyn Kelly’s “The Kelly File” Tuesday night to argue he was singled out for prosecution because he is a critic of the administration.
And he vowed to continue his work.
Under a plea agreement with prosecutors, D’Souza could face up to 16 months in prison for steering $20,000 in contributions to the Senate campaign of a longtime friend in New York in 2012. In return for the guilty plea, D’Souza said, the government agreed to drop a more serious charge that could have landed him in prison for five years.
D’Souza told Kelly the plea was the best he could do after a judge refused to allow his challenge on the grounds of selective prosecution.
D’Souza wasn’t the only one who questioned the government’s motives, Kelly pointed out, noting that critics as diverse as conservative Republican Sen. Ted Cruz and liberal law professor Allen Dershowitz had accused prosecutors of targeting D’Souza imprisonment for political reasons.
Even President Obama’s 2008 campaign was fined $375,000 for various campaign finance infractions, Kelly said, but “no was threatened with prison.”

“When I look around the country, it’s remarkable to see the cases that do and don’t get pressed,” D’Souza said. “For example look at [Senate Majority Leader] Harry Reid. There seem to be multiple campaign finance things with him … and you look at numerous other cases, and it seems the Obama administration does not choose to push those, so that’s really the issue. It’s the issue of fair treatment.”
When Kelly asked if the whole experience had been frightening, D’Souza acknowledged it had, but that his voice would not be stilled.
“It’s a scary thing to have the federal government, which has a lot of power, having you in its sights,” he said. “It’s not going to deter me from speaking out on public issues, I’ll tell you that.”
