Fox News’ legal analyst Judge Andrew Napolitano found himself in a lively discussion Tuesday with Jon Stewart on “The Daily Show,” centered on a contentious charge he recently made against Abraham Lincoln.
Napolitano had previously said that slavery in America was “dying a natural death … instead of allowing it to die, or helping it die, or even purchasing the slaves and then freeing them, which would’ve cost a lot less money than the Civil War cost, Lincoln set about on the most murderous war in American history.”

The two men got deep into a discussion about the 16th president of the United States, with Napolitano insisting that Lincoln had not exhausted all non-violent options, to include legislative measures, to end slavery.
“Why is the onus on Lincoln and not the southern states?” Stewart asked. “They seceded from the union—before he took office, as a matter of fact.”
“The leaders of the southern states perpetuated this immoral system, I have no praise for them whatsoever,” Napolitano replied. “Lincoln could have undone it without spending $6.6 billion and causing the death of 785,000 human beings.”
“Your vision of the Civil War is that Lincoln pulled a fast one on the South?” Stewart asked.
“Yes!” Napolitano replied.
