State senator trying again to make ‘revenge porn’ a felony

Ex-lovers who are no longer in the picture shouldn’t be posting pictures either – not if they contain sexual images, anyway.

revengeporn1212That’s the idea behind a bill filed by Florida state Sen. David Simmons on Thursday that would make it a third-degree felony in the state to “knowingly disclose a sexually explicit image of an identifiable person to a social networking service or a website or by means of any other electronic medium, with the intent to harass such person, if the individual knows or should have known that the person depicted in the sexually explicit image did not consent to such disclosure.”

Concerned about reports of women whose lives were disrupted by former lovers who posted sexually explicit images of them on the Internet, Simmons filed a similar bill last year that failed to make it out of committee.

So far, according to Time, only New Jersey and California have laws against posting sexual images without the subject’s consent – a practice known as “revenge porn” because it’s often a tactic used by spurned lovers to cause significant problems for their formerly significant others.

In the majority of cases, the spurned lovers are men trying to humiliate ex-girlfriends or ex-spouses after the breakup of a relationship.

“The ability of a person to literally destroy another person by publication that can go all over the world –  that’s a lot of power that’s given to an individual to make some really bad decisions, destroy their lives and humiliate the other person,” Simmons told WGCU in November.

In other words, “revenge porn” is a dish best not served at all.
